1. Introduction
The purpose of this Personal Data Privacy Policy and Use of Cookies (the “Privacy Policy”) is to inform you of the manner in which LABORATORIOS BIOMONT S.A. (hereinafter BIOMONT) will process the Personal Data it collects through questionnaires and written consents or those granted by filling out electronic forms.
We would appreciate it if you read this Privacy and Cookies Policy before providing us with your personal data on an optional basis and, if you agree, check the corresponding acceptance box in advance and expressly. These data are necessary to fulfill the purposes described in this Privacy and Cookies Policy; therefore, by not allowing their processing, we would not be able to comply with them.
2. Regulatory Framework
This policy is regulated by Peruvian legislation and in particular by the Personal Data Protection Law:
- Law No. 29733 and its amendments: Personal Data Protection Law (hereinafter, “Law”).
- Supreme Decree No. 003-2013-JUS and its amendments, which approves the Regulations of Law No. 29733 (hereinafter, “Regulations”).
- Information Security Directive managed by the Prospective Client Database: RD No. 199-2022-JUS/DGTAIPD-DPDP (hereinafter, “Directive”).
3. Use and Processing of Personal Data
BIOMONT informs you that any personal data that may be provided, as well as any data that may be provided in the future within the framework of your legal relationship with this entity, will be incorporated into files owned by BIOMONT.
These files are intended to manage, administer, provide you with the services or facilitate the products you request, and where appropriate, for the fulfillment and execution of contracts you may enter into, to better understand your tastes, adapt the services to your preferences, as well as to be able to offer you new products and send you information related to BIOMONT’s activities, through any means, including electronic means. The recipients of the information collected will mainly be BIOMONT employees, except in the fields where it is expressly determined otherwise by means of an asterisk (*). The answers to the questions about personal data are voluntary, and the lack of response to these questions will not imply a reduction in the quality of the services you request. The failure to complete the fields determined as mandatory or the supply of incorrect data will make it impossible for BIOMONT to provide you with the services or facilitate the products you request. Users guarantee and are responsible, in any case, for the accuracy, validity and authenticity of the personal data provided and undertake to keep them duly updated.
4. Exercise of ARCO rights
Any natural person who has provided their data to BIOMONT may exercise free of charge the rights of access, rectification, cancellation and opposition with respect to the data included in BIOMONT’s files.
Given the confidential nature of the information, you will not be able to exercise your rights by telephone. You must request it by any means that leaves proof of its sending and receipt and send a copy of your ID or equivalent document.
The interested party may exercise their rights by means of written communication addressed to BIOMONT at datospersonales@biomont.com.pe, indicating their full name, ID number and type of request to be made.
5. Security Measures
BIOMONT informs you that it has implemented the necessary technical and organizational security measures to guarantee the security of your personal data and prevent its alteration, loss, processing and/or unauthorized access, whether by physical or virtual means.
The user must be aware that Internet security measures are not impregnable and entirely reliable and that BIOMONT cannot guarantee the absence of viruses or other elements that could cause alterations in the user’s computer systems (software and hardware).

8. Cookies used by BIOMONT
The BIOMONT website contains 10 cookies:
- ga*: This is a Google Analytics cookie. It is used to distinguish users and track the performance of visits on the website. The cookie collects information anonymously and is mostly used to calculate visitor, session and campaign data.
- _ga: Similar to the previous cookie, this is another Google Analytics cookie. Its main function is to differentiate unique users by assigning them a unique identifier (ID). This cookie is key in measuring how users interact with the website and allows for reporting on the website’s performance.

11. Scope and Period of Conservation
This Privacy and Cookie Policy will apply to the processing of the User’s Personal Data contained in the Database indicated in this Policy for the duration of the contractual relationship or the link between the User and BIOMONT. Subsequently, the Personal Data will be kept for promotional purposes provided that said Purpose has been expressly accepted by the User and as long as its cancellation is not requested by the data owner in compliance with the Personal Data Protection Law.
The User expressly accepts this clause, which details the Cookies Policy. Therefore, acceptance of this Privacy Policy implies acceptance of the Cookies Terms of Use described therein.
